  • More Consolidation in Toyota Cases

Plaintiffs’ lawyers have not been unified in pushing for a consolidation of cases in claims against Toyota Motor Corp., with some lawyers expressing concern that the process will significantly slow down their clients’ claims. According to the National Law Journal story, however, Los Angeles Superior Court Judge Carl West has tentatively ruled to consolidate 21 California state court cases. The NLJ reports that five plaintiffs’ lawyers representing eight cases opposed the ruling. The approximately 300 cases in the federal courts have already been consolidated in multidistrict ligation (MDL) in Santa Ana, Calif.

Supporting the consolidation in CA state cases was Mark Robinson of Robinson, Calcagnie & Robinson, a perennial member of our Lawdragon 500 leading lawyers guide. Robinson is also a plaintiffs’ co-liaison counsel for the MDL. Lisa Gilford, the Alston & Bird partner representing Toyota, also wants the cases consolidated. West said he was sympathetic to lawyers who oppose the move but that there were significant issues relevant to all of the cases. He didn’t rule on which judge will preside over the consolidated cases – that decision will be left with California Chief Justice Ronald George, another Lawdragon 500.
