When William Kilberg goes to bat for management he almost always scores a home run. The former solicitor for the U.S. Department of Labor has sculpted the face of labor and employment law before the U.S. Supreme Court for the past decade. In 1999, Kilberg helped redefine the term "disability," when he successfully argued before the high court that a former United Postal Service worker was not protected by the Americans with Disabilities Act because his health problem, or alleged disability, could be mitigated by medication. Kilberg set precedent again in 2001 when he established that federal ERISA law trumps individual state laws in dictating how a deceased person's life insurance benefits should be split among alleged beneficiaries. Most recently, Kilberg prevailed against employees on behalf of General Dynamics in an age discrimination case that proved that the Age Discrimination Employment Act is designed to protect workers in their old age rather than younger workers. Kilberg has served as a White House fellow and special assistant to Secretary of Labor George P. Schultz. At the time of his appointment as solicitor of labor in 1973, Kilberg was the youngest person to be appointed to a sub-Cabinet post in the U.S. government.
