Barnett is widely recognized for his extensive experience in eDiscovery, having pioneered many of the best practices now commonly used by corporations and litigators navigating multidistrict litigation and government investigations. Believing that eDiscovery can and should be used strategically by plaintiffs to accelerate trials and resolution, Barnett is working to augment and support an already formidable eDiscovery team at Seeger Weiss. In doing so, Barnett prioritizes the mentorship of younger attorneys to develop and hone their eDiscovery expertise, stressing the importance of this ever-evolving complex and critical component of high-stakes litigation.
Since joining Seeger Weiss, Barnett has been involved in multiple firm matters, including the following:
- Working as ESI Discovery Liaison in Alford v. The NFL Player Disability & Survivor Benefit Plan, Barnett led the negotiations on an ESI Protocol and Protective Order, argued a motion to compel, and deposed one of the Plan’s key witnesses.
- In the AT&T Data Breach MDL, Barnett was named ESI Liaison to the Plaintiff Executive Committee and was part of a team that successfully negotiated a Protective Order, Rule 502(d) Order, and ESI Protocol in three months despite steadfast opposition from counsel for Defendants.
- Barnett was briefly involved in In Re: Philips Recalled CPAP, Bi-Level Pap, and Mechanical Ventilator Products Litigation, supporting fellow Seeger Weiss attorneys pursuing unproduced mobile device data at the time that Phillips announced a global settlement.
- In the Allergan Breast Implant Litigation, Barnett was part of a multi-firm team working to reverse an unprecedented decision involving the shifting of costs for the scanning and production of FDA-mandated manufacturing files stored in Puerto Rico.
- In the Insulin Pricing Litigation, Barnett regularly consults with Seeger Weiss colleagues and counsel from other firms regarding effective unified review processes and procedures.
Prior to joining Dechert, Barnett served as an Assistant United States Attorney in the District of Columbia and the Eastern District of Pennsylvania. During law school, Ben worked on Capitol Hill for Representative Mo Udall and in the Transnational and Major Crimes Section of the U.S. Attorney’s Office for the District of Columbia.
