Max Kelly is a litigation associate at Seeger Weiss whose practice focuses on mass torts and class action lawsuits. Since joining the firm in 2019 after transitioning from defense-side work, Kelly has established himself as a dedicated advocate committed to holding corporations accountable for wrongdoing.
Kelly was a central player in the 3M Combat Arms Earplug Products Liability Litigation from its inception, serving on multiple trial teams that recovered seven-figure verdicts for injured service members in one of the largest mass torts in history. He also helped manage corporate discovery in East Palestine Train Derailment Litigation against Norfolk Southern Railway following the February 2023 East Palestine chemical train derailment, including taking the deposition of Norfolk Southern’s Director of Environmental Protection. In the Allergan Biocell Textured Breast Implant Products Liability Litigation, Kelly negotiated first-day orders, took depositions, briefed and argued discovery motions, and worked up bellwether cases.

Currently, Kelly works on the In re GLP-1 Receptor Agonists Products Liability Litigation, pursuing claims on behalf of users of Ozempic, Mounjaro, and similar drugs against Novo Nordisk and Eli Lilly regarding their failure to warn users of the risks of injuries associated with their drugs. In the GLP1 MDL, Max negotiated first-day orders, drafted and negotiated discovery requests, managed document discovery, drafted briefs on discovery motions and motions to exclude experts, and argued motions before the special master and Judge Marston.
A seasoned speaker on complex litigation topics, Kelly has presented at Mass Torts Made Perfect on discovery issues, served as a conversation leader at the Complex Litigation eDiscovery Forum, and delivered multiple CLEs at Seeger Weiss. He is an active member of several professional organizations, including State Bar Associations, the Complex Litigation E-Discovery Forum (CLEF), and the National Trial Lawyers (NTL).
Before joining the firm, Kelly was an associate at Milbank in New York, representing defendants in the financial services industry in complex commercial disputes, government investigations, and class actions. Kelly earned his J.D. from New York University School of Law in 2015, where he wrote for the Journal of Intellectual Property and Entertainment Law. He was also a research assistant to Professor Arthur R. Miller, providing revisions and updates to Federal Practice and Procedure, one of the most frequently cited treatises in federal court practice. He earned his B.A. from Kenyon College in 2010 and is admitted to practice in the states of New York and New Jersey, the District of New Jersey, the Eastern District of New York, the Southern District of New York, and the Court of Appeals for the Second Circuit.
