Timothy J. Cavanagh is the founding partner of Cavanagh Law Group in Chicago, Illinois. Velarde v. Illinois Central Railroad Co., et. al.
Verdict: $55,715,406 Offer: $ 3,000,000
On February 8, 2002, Cook County Circuit Court Jury awarded Fidel and Francisca Velarde a total of $55,715,406.65 for injuries suffered in a January 9, 2001 car train collision. Fidel, age 73, and Francisca, age 73, were passengers of an SUV struck by an 8 million pound train at 50 miles per hour. The crossing gates and lights were not working and the dispatcher erroneously told the train crew that the crossing was protected. The plaintiffs suffered traumatic brain injuries in the collision. The total award to the Velardes and their daughter, who was the driver of the car, totaled over $55 million--a state record in Illinois for a railroad crossing collision case.
Czapski v. Maher
Verdict: $13,720,007.98 Offer: $1.9 million
On April 20, 2009, Tim Cavanagh obtained a $13.7 million verdict on behalf of the Estate of Roger Czapski against Christopher Maher arising from a deadly automobile crash. After a two week long trial and 3 hours of deliberation, the jury returned the verdict finding Maher was 98% responsible for the wrongful death of Czapski.
On August 4, 2004, Czapski, age 22, was a salesman for Motor Werks of Barrington, Inc. That afternoon, Maher, a 20 year old from Inverness, Illinois, took a BMW 530i on a test drive, with Czapski riding as the front seat passenger and Maher's two friends seated in the back seat. The BMW violently collided with a left turning vehicle at the intersection of Algonquin Road and Willow Creek Church Drive. The BMW then ricocheted into a light post and exploded on impact.
At trial, witnesses to the collision, including the two back seat passengers in the BMW, testified that the BMW was traveling at 95 mph at the time of impact. The posted speed limit on Algonquin Road is 45 mph. Czapski was pronounced dead at the scene.
Czapski is survived by his father, mother and brother. At the time of his death, Czapski was living in Crystal Lake, Illinois. He graduated from Lane Tech College Preparatory High School in Chicago, Illinois on the honor roll and attended the University of Illinois at Champaign-Urbana for a brief time. He worked as a Motor Werks salesman for approximately 18 months before his death.
Bruce v. CAV International
Verdict: $6,551,059.61 Offer: $3,500,000
On February 14, 2014, Tim Cavanagh obtained a $6.5 million verdict for the family of John Bruce against government contractor, CAV International.
Bruce, 64, was working for United Airlines at Al-Mubarak Air Force Base in Kuwait in 2009. A distracted employee of CAV International moved the belt loader that Bruce was working on, causing him to fall more than 12 feet to the tarmac. He sustained a significant brain injury and died six days later after being taken off life support.
Police Officer v. Intergovernmental Risk Management Agency

A twenty-eight year old female Mundelein police officer was pinned between a limousine and her squad car when a limousine driver rear-ended plaintiff's squad car. Plaintiff suffered a near traumatic amputation of her right leg above the knee, multiple fractures of her left leg and the loss of her unborn fetus weeks later. Santillana v. City of Chicago and Jesus Gomez
Verdict: $2,005,798 Offer: None
On December 12, 2003, Cook County Circuit Court Jury awarded Elizabeth Santillana $2 million in a hotly disputed wrongful death case. The case arose out of a "police pursuit" on July 18, 2000 that resulted in Dalia Santillana's death when her vehicle was struck by a car driven by a man fleeing a Chicago Police Department squad car engaged in a "police pursuit." Evidence was presented that the police officers "rammed" the Gomez vehicle causing it to lose control and cross the center line. City of Chicago rules on "police pursuits" outlined in General Order 97-3 specifically prohibit "ramming" by squad cars. A Cook County jury rejected the City of Chicago's position that it was not engaged in the pursuit at the time of the fatal collision. Because the City was found 25% at fault, it is responsible for the entire verdict amount. The City declined to make a settlement offer prior to trial. News Article Available

Webb v. Dikcis Cab Company
Verdict: $586,000 Offer: None
The case arose from a two vehicle collision in which an uninsured drunk driver ran a red light and struck a cab in which the plaintiff was a passenger. Webb suffered a spinal cord injury resulting in his death. Webb, who had AIDS, had only months to live. The jury found the cab company twenty-five percent responsible for its driver's decision to pull into the intersection without observing the approaching speeding car. The jury verdict resulted in joint and several liability against the cab company.

A seventeen year-old girl was a passenger in a vehicle involved in a one-car crash in Colorado. The plaintiff sustained a de-gloving injury to her arm requiring surgery. The verdict was the highest reported verdict in the history of Morgan County, Colorado.

Cazares, et. al. v. Frugoli and The City of Chicago $20,000,000
Tim Cavanagh obtained a $20 million settlement for two families who were the victims of the “Code of Silence” in the Chicago Police Department. On April 11, 2009, off-duty police officer Joseph Frugoli crashed into the disabled car of Cazeres and Manzera, trapping them in a burning car. Cazeres and Manzera died at the scene of the accident. Frugoli was found to have a blood alcohol content three times the legal driving limit. The case settled during Tim’s closing argument after two weeks of trial.
Vlachos v. Hungerford, et al. $14,000,000
Tim Cavanagh obtained a $14 million settlement for a 5-year old Chicago boy who suffered a severe brain injury during birth after hospital staff members mixed up his heart rate with his mother’s pulse. The malpractice complaint against Northwestern Memorial Hospital contended the baby was not breathing when he was born and that emergency staffers were not prepared to resuscitate him because of the monitoring error. The 7-minute lapse without oxygen caused the child to suffer cerebral palsy, leaving his arms and legs paralyzed.
Cenar v. Doka, et al. $9,750,000
A trucking company agreed to pay $9.75 million to settle a case involving a cyclist hit by a truck driver. Tim Cavanagh secured this multi-million-dollar settlement for Terri Cenar on the eve of the trial. A truck driver failed to check before he turned right, wedging Terri's bike under the truck tire and the pavement. Terri suffered a broken pelvis, injuries to her stomach, bladder, left leg, groin, and vulva. Tim Cavanagh traveled across the globe to depose employees of the involved trucking company and tenaciously worked to discover facts surrounding the incident. This is a state record in Illinois for a case involving a vehicle and a bicyclist. This case was set for trial in December of 2014.
Ajmeri v. Illinois Central Railroad Company $9,100,000
Tim Cavanagh obtained a $9.1 million settlement for a woman left with nerve and mild brain damage when a train collided with the car on March 9, 1998. Hanifa Ajmeri was hit by a train owned by the Illinois Central Railroad Company and operated by Chicago Central and Pacific Railroad Company. The crossing lights were not visible at the time of the accident due to blizzard conditions and the knocked down southbound traffic gate. Chicago Central violated federal transportation rules by not informing Illinois Central that the traffic gate had been knocked down. The case settled on the third day of trial for a state record amount involving a train-vehicle collision according to the Cook County Jury Verdict Reporter.
Ruffin v. Metra $7,500,000
On June 1, 2017, Tim Cavanagh and Michael Sorich secured a $7.5 million settlement on behalf of a woman against Metra for traumatic injuries caused by a passing commuter train. On October 25, 2011, the plaintiff arrived at the Metra Electric District Line 87th Street flag-stop station to wait for her train. Trains do not stop at this location unless the conductor sees a passenger waiting to board. Because of track construction, the plaintiff’s train was rerouted and required special boarding instructions that asked passengers to wait in a specific area that was supposed to be secured by a chain. This information was not conveyed to Ruffin or other passengers. Metra did not properly secure the special boarding area with the chain and as a result, the plaintiff was forced to wait to for the train in a dangerous area in order to be seen by the conductor. The plaintiff suffered grievous injuries when she was struck by the passing Metra train.
Hopkins v. Westlake Hospital $7,500,000
A forty-two-year-old mother of three presented at the emergency room with chest pain. The hospital staff failed to provide an EKG immediately and provided a drug that sped up the heart. Plaintiff suffered a myocardial infarction and suffered brain damage. Tim Cavanagh obtained the $7.5 million settlement during the defendant’s case after two weeks of trial.

Tim Cavanagh obtained a $6.3 million wrongful death settlement for the family of a young man killed at work. The case arose out of a two-vehicle automobile crash that resulted in the death of a passenger in one of the cars. The lawsuit was litigated for 7 years and was appealed to the Illinois Appellate Court on two separate occasions. The name of the case is being withheld as several of the insurance companies involved in this record payout demanded confidentiality of the settlement. Tim Cavanagh, the founding partner of Cavanagh Law Group, stated: "The family is gratified that this case is finally resolved, and that justice has been served. Their perseverance and courage in this lengthy litigation allowed Cavanagh Law Group to fully litigate the case and recover this record settlement."
Kriete-Green v. Adan’s Trucking, Inc., et. al. $5,900,000
On October 5, 2017, Tim Cavanagh secured a $5.9 million settlement on behalf of Mary Kriete-Green for the death of her husband, Dan Green. On September 12, 2011, Daniel Green, age 38, was an employee of Hecker Electric in Wheeling, Illinois. That afternoon, Green was struck and killed by a semi-truck taking a sharp right turn onto Lake Street from York Road in Elmhurst, Illinois. Days after the crash, an employee of R&G Engineering admitted trucks frequently drove over the curb where Green was working. R&G and other construction companies failed to provide proper safety devices to protect workers at the corner intersection. Green is survived by his wife Mary Kriete-Green.
Szynalik v. CTA $5,550,000
On the eve of trial, Tim Cavanagh obtained a $5.55 million settlement for the family of a woman killed in Chicago on December 31, 2007. Ludwika Szynalik, age 59, was a passenger on a Chicago Transit Authority bus traveling west on Addison Street near its intersection with Natchez Avenue. As the bus stopped, Szynalik exited the bus and went to retrieve her bicycle that she had previously placed on the bus’ front bicycle rack. As Szynalik attempted to remove her bicycle, the CTA’s bus driver suddenly accelerated, ran her over and dragged her approximately 100 feet down the street. Szynalik was immediately rushed by paramedics to a nearby hospital where she survived for a few hours.
Cavanagh Law Group had a protective order entered to preserve all evidence related to the horrific incident. Numerous cameras installed on the CTA bus recorded Szynalik in the last moments of her life. The video footage showed the bus accelerating and running over Szynalik while she is clearly in view of the bus driver.
Taylor v. Salvation Army $4,500,000
In October 2003, Tim Cavanagh obtained a $4.5 million wrongful death settlement for the family of a woman killed in a collision between a van and a semi tractor-trailer. The case settled immediately prior to jury selection after lengthy discovery.
Barnes v. Berry Electric Contracting Company, Inc., et al. $4,100,000
A seventy-year-old grandmother was driving to the store when her vehicle was broadsided by a truck driven by Dennis Svec, an employee of Berry Electric. Svec was lost and looking at his Blackberry device when his vehicle entered the intersection. Witnesses testified that Svec ran the red light although one witness disagreed. Mrs. Barnes suffered multiple traumatic injuries including a C4-5 distraction injury and dura tears requiring anterior and posterior fusion surgeries, multiple pelvic fractures requiring external fixation surgery, punctured heart, rib fractures, closed head injury and cranial nerve palsy.
The case settled immediately before opening statements one year to the day of the crash. The case was advanced to trial after Mr. Cavanagh took over 30 depositions in twelve months.
Shafer v. Wolin-Levin $3,020,000
Tim Cavanagh obtained a $3 million settlement for a thirty-two-year-old woman who suffered an electrical shock in her kitchen because the landlord improperly wired an electrical outlet. The woman developed four level complex regional pain syndrome resulting in a surgery implanting a pain device in her back.

Tim Cavanagh obtained a $3 million wrongful death and negligence settlement for the family of a twenty-six-year-old man who suffered fatal injuries resulting from an unreasonably dangerous and defective salt spreader. Timothy Pittas was working for his family’s landscaping company when he clothes became entangled in the auger of the machine. Tim and the Pittas family sought to change the industry as there had been numerous similar incidents, and the manufacturer should be held responsible for the preventable tragedy.
Munoz v. Mack Trucks, et al. $3,000,000
A thirty-two-year-old employee at Waste Management suffered an amputation of his leg below the knee after his leg was caught in between the arm and cab of a dump truck. A product liability lawsuit was filed alleging that the truck was designed defectively because the pinch point was not protected.
Johnson v. Secura $2,500,000
Tim Cavanagh obtained a $2.5 million uninsured motorist settlement for the five victims of a highway crash.
Wiers v. Northwestern Memorial Hospital, et al. $2,500,000
On November 30, 2003, a pregnant mother presented to Northwestern Memorial Hospital to induce labor and delivery. The attending obstetrician performed a forceps delivery that we alleged caused a brain hemorrhage to the newborn. The child was subsequently diagnosed with cerebral palsy and associated physical and cognitive deficits. The case settled during trial in the Circuit Court of Cook County.
Meeks v. State of Nebraska $2,000,000
On June 6, 2013, Joyce Meeks, a former Chicago resident, was driving home from work on Van Dorn Street in Lincoln, Nebraska. A vehicle driven by Jeremy Dobbe crossed the center line, striking the Meeks vehicle at 70 mph and killing Joyce instantly. Dobbe was in prison and was driving a vehicle owned by the Nebraska Department of Corrections as part of the Inmate Van Driver Program. This program allowed inmates of Nebraska prisons to drive state vehicles on public roads as part of a work detail assignment.
Dobbe had two convictions for DUI, one in Colfax County in 1999 and one in Platt County in 2003, a conviction for Reckless Driving in Stanton County in 2001, a conviction for Willful Reckless Driving in Platt County in 2005, a conviction for Careless Driving in Colfax County in 2010, and a conviction for Possession of Marijuana in Platt County in 2000. Dobbe also had a felony conviction in Butler County for Possession of Methamphetamine with Intent to Deliver, a felony conviction for Terroristic Threats in Colfax County, and a misdemeanor conviction for criminal mischief in Colfax County. Despite this record of convictions, Dobbe was allowed by the State of Nebraska to drive a state-owned van on public streets to pick up other inmates at their respective work detail assignments.
As a result of this case, Cavanagh demanded that Nebraska ended its Inmate Van Driver Program and the state agreed.
Egbert v. Roman Catholic Diocese of Joliet, et al. $1,900,000
A 38-year-old man was on his motorcycle stopped at a red light when he was struck from behind by a vehicle driven by a Catholic priest. The impact threw the man onto the hood of the priest’s vehicle and as a result, the man sustained multiple injuries, including a closed head injury. The matter settled the day before trial.
Kuk v. Metra $1,800,000
Passengers on a Metra train were injured when the train derailed in a railroad maintenance yard due to the train’s engineer missing a red stop light. Two locomotives and five passenger cars derailed at a speed of 68 mph, resulting in one Plaintiff suffering knee and lower back injuries. Tim Cavanagh obtained the settlement after a week of trial.

This wrongful death case arises after a man was brought to Loyola for burn injuries but died when the doctors failed to treat him correctly.
Muff v. Isakovic, et al. $1,300,000
Tim Cavanagh obtained a $1.3 million settlement for Colleen Muff and her deceased parents against Isakovic and Baffi LLC, DBA Motorcar Solutions. Muff and her parents, Robert and Norine Fridlund, were traveling to a graduation celebration on I-290 east of North Avenue near Elmhurst, when the driver of an Acura crashed into the back of Muff’s car, pushing her vehicle underneath the trailer of a semi-truck. Muff was injured, and her parents were killed in the collision. The case settled for the limits of all insurance coverage available.
Szczypka v. Marback $1,250,000
Tim Cavanagh obtained a $1.25 million settlement for a man struck by a car while crossing the street. Edward Szczypka was injured when he was struck by defendant Marback’s car.
Cottrell v. State Farm Automobile Insurance Company $1,200,000
Seventeen-year-old high school honor student killed in one-vehicle crash in McHenry County, Illinois. The case settled for the full amount of the insurance policies available on the vehicle after State Farm Automobile Insurance Company was sued for spoliation of evidence.
Tufano v. Zienkiewicz $1,050,000
Tim Cavanagh obtained a $1.05 million settlement for injuries sustained by Erin Tufano who was a passenger in a car struck by two underinsured drivers. Having obtained the limits of the defendant’s insurance coverage, plaintiff moved to have her own insurance policy cover the gap. Tim succeeded in obtaining the full amount of insurance coverage after a successful appeal to 1st District Appellate Court of Illinois, ensuring Tufano would collect the full amount of insurance coverage for her lifelong injuries.
Khan v. Horga $1,000,000
Tim Cavanagh obtained a $1 million settlement on behalf of Maria Tahir and Tahir Khan against the owner of an apartment building who failed to have working smoke detectors that were required by Chicago Municipal Code. On November 9, 2014, a fire trapped Maria Tahir, Tahir Khan, and their children in their third-floor apartment. Tahir was forced to drop two of his children to safety from the third-floor window. Ans Khan was not able to escape the fire and sustained injuries that resulted in his tragic death. Ans Khan is survived by his two siblings and his parents, Maria and Tahir.
Chung v. DND Consulting, et al. $1,000,000
Tim Cavanagh obtained a $1 million settlement for a fifty-year-old construction worker. The man was working at a construction site and fell 20 feet through a hole in a roof covered with a tarp, suffering multiple fractures and permanent nerve damage. The defendants failed to properly guard the hole in the roof in violation of safety codes.

Tim Cavanagh obtained a $1 million settlement for a woman who suffered neck and shoulder injuries when a man drove his Jaguar into a Starbucks Coffee shop. The man’s car struck a table occupied by two women.

Tim Cavanagh obtained a $1 million settlement for a young man who suffered traumatic injuries when a truck drifted over the center line and collided with his car.
DeJule v. Solberg $1,000,000
Tim Cavanagh obtained a $1 million settlement for a young man who suffered a neck injury in a car crash leading to cervical fusion surgery.
McGill v. G.G. Connections, Inc. $1,000,000
Tim Cavanagh obtained a $1 million settlement for a mother and son who were killed in a two-vehicle collision when a truck driver ran a red light. Tim obtained the full limits of the trucking companies' insurance policy in the settlement.
Byrnes v. Care Centers, Inc. $900,000
The case stems from an incident that occurred at Wheaton Care Center nursing home on April 23, 2002, and resulted in the death of Plaintiff’s decedent, Adrienne Byrnes. Ms. Byrnes death was caused by salicylate toxicity and it is believed that she consumed multiple aspirin tablets while at the Wheaton Care Center nursing home. Plaintiff alleges that Defendants were storing, distributing, and supervising medications at the nursing home.
Hastings v. Confidential $850,000
Tim Cavanagh obtained an $850,000 settlement for an 85-year-old airline passenger who was injured as a result of an improper boarding procedure at Chicago Midway Airport. Tim’s client sustained a comminuted fracture of the femur while being transported in a wheelchair to board a plane.
