A partner in the Litigation Department, James Brochin focuses his practice on white collar criminal defense, government regulatory matters, and complex civil litigation. He represents both individuals and corporations in a wide variety of government investigations, including several high-profile investigations by the Department of Justice, the New York Attorney General’s Office, and the Securities and Exchange Commission. Jim’s practice also includes a variety of complex civil matters in areas ranging from securities fraud and shareholder derivative suits to product liability and actions under the Racketeer Influenced and Corrupt Organizations Act (RICO).

Experience

Recent significant matters include:

  • Representation of a public gaming company in a joint Justice Department/SEC investigation involving possible violations of the FCPA in connection with the company's overseas operations.
  • Representation of three Fortune 500 pharmaceutical corporations in separate Justice Department investigations into alleged off-label marketing.
  • Representation of the Chairman of a major Swiss bank in Justice Department and SEC investigations into tax fraud and securities violations arising out of the bank's cross-border private banking business.
  • Representation of the former Chief of Staff to the Vice President in his highly publicized trial and subsequent proceedings.
  • Representation of former New York Governor Eliot Spitzer.
  • Representation of the General Counsel of a telecommunications company in Justice Department and SEC investigations into stock options backdating.
  • Representation of a software company in a securities class action and related shareholder derivative suits arising out of allegations of misconduct against its former CEO.
  • Representation of Swiss Re in class action litigation concerning its writedown of credit default swaps.
  • Representation of a major tobacco company in defense of one of the largest civil RICO cases ever brought.

From 1995-1996, Jim served as Associate Independent Counsel in the investigation of the Secretary of Agriculture. Jim clerked for the Honorable Kimba M. Wood of the United States District Court for the Southern District of New York. He served as a notes editor of the Yale Law Journal.
