Co-chair of the Paul, Weiss Litigation Department and a member of the firm's Management Committee, Michael E. Gertzman has amassed extensive experience in handling complex criminal, regulatory and civil litigation matters, with a special emphasis in the securities and antitrust areas.
Experience
Mike has tried more than a dozen civil and criminal cases to verdict in federal and state courts around the country. He has represented numerous corporations and individuals in a variety of criminal, SEC and other regulatory investigations and related civil litigations and arbitrations involving allegations of securities fraud, accounting fraud, price-fixing, violations of the Foreign Corrupt Practices Act, insider trading, and other alleged misconduct. He also regularly represents companies, partnerships and their executives and principals in civil litigation and arbitrations involving breach of contract, breach of fiduciary duty, fraud, and other commercial claims.
Mike recently has represented:
- U.S. and Japanese companies and their executives in criminal price-fixing investigations and related civil litigations;
- a significant Japanese financial institution in U.S. regulatory proceedings;
- public companies, private equity funds, hedge funds, and their principals in Department of Justice and SEC investigations, regulatory matters, and intra-firm disputes;
- a pharmaceutical company headquartered in Japan in an off-label marketing investigation and related whistleblower litigation;
- public companies, underwriters, executives and officers in securities class actions;
- U.S. and Japanese companies in Foreign Corrupt Practices Act investigations;
- a large, publicly traded company based in Japan and its senior executives, including its chairman, CEO and other top officers, in a multinational criminal price-fixing investigation and related civil litigation;
- one of the world's largest construction companies in a Department of Justice investigation of fraud allegations;
- the former chairman, CEO and president of HBOC Corporation in defense of criminal securities fraud charges;
- Citigroup and its executives in defense of SEC and other regulatory investigations, securities class actions and fraud allegations;
- Citigroup in defense of a securities class action involving Dynegy Corporation;
- Swedish health care giant Gambro, AB in a civil securities fraud litigation;
- a large public U.S. company in a grand jury investigation by the New York Attorney General's Office; and
- the CFO of a major public company embroiled in an accounting scandal.
Between 1992 and 1996, Mike served as an Assistant United States Attorney in the Southern District of New York. There, he prosecuted a broad array of criminal matters, including securities fraud, mail and wire fraud, insider trading, public corruption and others. He also taught trial litigation skills at a Department of Justice seminar and received the Attorney General's Award for Superior Performance.
In 2014, Benchmark Litigation named Mike a New York Litigation Star in the areas of white collar crime, enforcement, FCPA, securities, antitrust and general commercial litigation.
